Terms of Use
These Terms of Use ("Terms") govern your access to and use of the TrackDyno iOS app and this website (together, "TrackDyno"). By installing, opening, or using TrackDyno you agree to these Terms. If you do not agree, do not use the app or the website.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use TrackDyno. By using the app you represent that you meet that requirement.
2. Closed-course use only
TrackDyno is provided as a tool for measuring vehicle performance in controlled, lawful environments. You agree that you will not use TrackDyno on public roads to perform high- acceleration runs, top-speed runs, drag-strip-style timed runs, or any other activity that would violate applicable speed limits, traffic laws, or motor-vehicle regulations.
Speeding on public roads endangers you and others. TrackDyno does not authorize, encourage, or condone illegal driving. The features of the app are designed to be useful at a closed course, where speed limits do not apply and the environment is controlled.
3. Measurements are estimates
All quantities displayed by TrackDyno — including but not limited to speed, acceleration, elapsed time, distance, horsepower, torque, RPM, lap time, reaction time, and atmospheric conditions — are estimates derived from the iPhone's GPS, IMU, barometer, and microphone, fused with atmospheric data from Apple WeatherKit. They are NOT:
- Certified dynamometer or chassis-dyno readings.
- Official lap-timing results.
- Legally admissible measurements of speed, distance, or acceleration.
- Suitable for safety-critical decisions of any kind.
Real-world results vary significantly with vehicle configuration, sensor accuracy, GPS quality, atmospheric variables, and other factors. Do not rely on TrackDyno's estimates as a substitute for proper measurement instruments where accuracy matters.
4. Assumption of risk
Motor sport and high-performance driving carry inherent risks of property damage, injury, and death. By using TrackDyno you acknowledge those risks and agree that you are solely responsible for your own driving and any consequences of that driving, including but not limited to:
- Mechanical damage to your vehicle.
- Personal injury to yourself or others.
- Property damage of any kind.
- Civil, criminal, or regulatory liability of any kind.
5. No warranty
TrackDyno is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate, or that any defect in the app will be corrected.
6. Limitation of liability
To the maximum extent permitted by law, in no event shall the developer, its officers, directors, employees, agents, or contractors be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of, or inability to use, TrackDyno — whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not the developer has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such jurisdictions, the developer's liability is limited to the maximum extent permitted by law.
7. Don't interact with your phone while driving
Configure the app, choose a mode, and start any recording before you begin driving. Do not adjust settings, view results, or otherwise interact with the device until you have come to a complete stop in a safe location. Distracted driving is illegal in most jurisdictions and is a leading cause of crashes.
8. Intellectual property
TrackDyno, the TrackDyno name, the TrackDyno logo, the user interface, the source code, and all related materials are the property of the developer and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to install and use the app on iOS devices you own or control, solely for your personal, non-commercial use.
9. Changes
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and surface meaningful changes in the app the next time you open it. Continued use after the changes take effect constitutes your acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of TrackDyno shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
